When Selling A Used Car “as-is”, Does The Car Have To Pass A Smog Inspection To Transfer Ownership?

i own a repair shop,,and no it don’t,,you can sell it to anyone,,but its up to them to make sure that it passes the smog test,,they may not buy it though if they take it and have it checked,,and see that it wont pass the test,,so really its all up to you,,if it wont pass it might pay you to have it repaired now before you sell it,this way you know it will be OK,good luck i hope this help,s.

  2. It depends on the state, some make the seller get the emissions test before they can sell a car.
    in ohio it is illegal to sell a vehicle that will not pass state emmissions testing regardless and if the issue was pushed they could come back on you as a private owner but it is not likely especially if you make it known to the prospective buyer (maybe have them sign somthing).
    dealers on the other hand have to fix it or take the car back in most states.
    Ohio is doing very little of this now days though which put me out of a job.

  8. if u own it and ur the one selling it yes but if its dealer owned yes or even used car dealer but as is means as is no matter what the state is

  9. I really think that would depend on what state you live in.

  10. Not in Georgia the new owner must get it fix or get a wavier for the smog inspection. In Georgia you must spend up to a limit before you can get a wavier. Other states will differ and some states and /or counties do not require any smog testing.

  11. No, only a dealer has to “certify” the vehicle as street legal. People sell cars for parts all the time and they would not pass inspection!
